Warranty Terms
When you buy a product from Klarq, you benefit from two different types of protection. It is important to understand the difference between them, because they have different scopes, durations, and enforcement routes.

Your statutory legal guarantee rights are always available to you regardless of what any manufacturer warranty says. A manufacturer warranty cannot reduce or replace your legal rights.
What it covers
Under Estonian and EU law, every product we sell must conform to the contract at the time of delivery. A product conforms to the contract if it:
- Matches its description, type, quantity, and quality as stated on the product page;
- Is fit for its intended purpose and for the purposes for which goods of that type are normally used;
- Has the features and durability you would reasonably expect given its nature and any public statements made about it;
- Is delivered with all accessories, instructions, and packaging reasonably expected.
How long does it last?
The legal guarantee lasts for 2 years from the date you receive the product. This is the minimum period required by law and cannot be shortened by any term in these or any other documents.
If a defect becomes apparent within the first 12 months of delivery, it is legally presumed to have existed at the time of delivery, and we bear the burden of proving otherwise. After 12 months, you may be asked to demonstrate that the fault is not the result of normal wear and tear or misuse.
What is not covered
- Damage caused by accident, misuse, or failure to follow the product instructions;
- Normal wear and tear over time;
- Damage caused by unauthorised modifications or repairs;
- Cosmetic damage that does not affect the product's function (e.g. minor scratches);
- Consumable parts that are expected to wear down with use (e.g. batteries, unless the defect relates to the battery itself);
- Faults caused by use of incompatible accessories or third-party components not recommended by the manufacturer.
Your remedies, in order
If a product is defective and covered by the legal guarantee, we will resolve the issue in the following order of preference, as required by law:
Repair: we will arrange for the product to be repaired, at no cost to you, within a reasonable time and without significant inconvenience.
Replacement: if repair is not possible or would cause disproportionate inconvenience, we will replace the product with an equivalent new or equivalent-condition item.
Price reduction: if you prefer to keep the product despite the defect, you may request a proportionate reduction in price.
Full refund and contract termination: if repair and replacement are both impossible, have failed, or would cause you significant inconvenience, you may withdraw from the contract and receive a full refund.
All repairs and returns under the legal guarantee are carried out at our expense. You will not be charged for collection, return shipping, labour, or replacement parts related to a valid guarantee claim.
Many products sold on Klarq come with an additional commercial warranty provided directly by the manufacturer. This warranty is separate from your legal rights and is offered at the manufacturer's sole discretion.
The terms of the manufacturer warranty (including its duration, scope, what is covered, and how to make a claim) are set out in the warranty card or documentation included in the product box. Please keep this documentation safe.
Manufacturer warranties may offer advantages beyond the statutory guarantee (for example, a longer duration or on-site service), but they may also contain exclusions that the legal guarantee does not permit. If there is any conflict, your statutory legal rights always prevail.

To make a claim under the statutory legal guarantee, please follow these steps:
Contact us: email hello@klarq.ee with the subject line "Warranty Claim". Include your order number, a description of the defect, and photos or a short video of the issue where possible.
We acknowledge your claim: we will respond within 3 business days to confirm receipt and let you know the next steps.
Assessment: we will assess whether the defect is covered. We may ask you to return the product for inspection, or arrange a collection at our cost. We will not ask you to pay for any shipping at this stage.
Remedy: once the defect is confirmed, we will carry out the appropriate remedy (repair, replacement, or refund) within a reasonable time. We aim to resolve claims within 30 calendar days of receiving the product back.
What to include in your claim email
- Your full name and order number;
- The product name and model number (found on the box or product label);
- A clear description of the defect or non-conformity;
- When you first noticed the problem;
- Photos or video evidence where possible.
If we ask you to return a defective product for inspection or replacement, we will arrange and pay for the return shipment. We will provide you with a prepaid return label or arrange a courier collection; you will not be asked to pay upfront and seek reimbursement.
Please ensure the product is packaged securely for return. Where possible, use the original packaging. We are not responsible for damage caused during return transit if the product was not adequately packaged.
Where a refund is the appropriate remedy under §2, we will process it within 14 days of agreeing the refund with you, using the same payment method you used to purchase the product, unless you explicitly agree to a different method.
We may deduct an amount reflecting any diminished value of the product if the product has been used beyond what is necessary to establish its nature, characteristics, and functioning.
The statutory 2-year legal guarantee described in §2 applies to consumers only. Business customers have rights under the general provisions of the Estonian Law of Obligations Act, but the mandatory consumer-protection aspects of the legal guarantee (including the presumption of defect within 12 months and the specific hierarchy of remedies) do not apply to B2B sales.
Business customers should raise defect claims with us within a reasonable time of discovering the defect.
