These Terms and Conditions ("Terms") govern every purchase you make through the Klarq online shop at klarq.ee ("the Shop"). Please read them carefully before placing an order.

By placing an order you agree to these Terms. If you are purchasing on behalf of a company or organisation (a "Business Customer"), these Terms also apply, but certain consumer-specific rights described below do not apply to Business Customers.
We sell smart home products, electronics, household appliances, and tech accessories. All products are described on their individual product pages. We make reasonable efforts to ensure descriptions and images are accurate, but minor variations may occur.
Many of our products are available to order even when not currently in stock ("backorders"). Where a product is on backorder, the estimated dispatch timeframe will be shown on the product page or confirmed in your order confirmation. If a product on backorder becomes unavailable, we will notify you and offer a full refund or an alternative product.
We reserve the right to limit quantities per customer or household where reasonably necessary.
All prices displayed on the Shop are in euros (€) and include Estonian VAT at the applicable rate. The price you see is the price you pay for the product. No hidden charges are added to the product price itself.
Delivery charges (if applicable) are calculated at checkout and shown clearly before you confirm your order. You will not be charged any payment processing or handling fees.
We reserve the right to correct pricing errors. If a pricing error is discovered after you have placed an order, we will contact you before processing the order. You may then choose to proceed at the correct price or cancel the order for a full refund. We are not obliged to honour a clearly incorrect price.
Placing an order on Klarq works as follows:
1. Add items to your shopping cart. 2. Proceed to checkout and enter your delivery and contact details. 3. Choose your delivery method. Delivery costs, if any, will be shown clearly. 4. Review your full order summary, including total price with VAT and any delivery costs. 5. Complete payment via MakeCommerce. Payment is processed securely by Maksekeskus AS. By submitting payment, you are making a binding offer to purchase the items in your cart. 6. Once payment is confirmed, you will receive an order confirmation email to the address you provided. This email constitutes our acceptance of your order and forms a binding contract between you and Brandweb OÜ.
We recommend you save or print the order confirmation for your records. If you do not receive a confirmation email within one hour of payment, please contact us at hello@klarq.ee.
We reserve the right to cancel or refuse an order after confirmation in the following circumstances: • The product is out of stock and cannot be sourced within a reasonable time; • A pricing or product description error has occurred; • We cannot verify payment or the payment is declined or reversed; • There is reasonable suspicion of fraudulent activity or abuse; • Applicable laws or regulations prevent us from fulfilling the order.
If we cancel your order, we will notify you promptly and issue a full refund of any payment received within 14 days.
Payments are processed exclusively through MakeCommerce, operated by Maksekeskus AS, which offers bank link payments, card payments, and other payment options. By completing a payment, you confirm that you are authorised to use the payment method provided.
Payment is due at the time of ordering. We do not dispatch goods until payment is confirmed.
If a payment is reversed or charged back after dispatch without a valid reason, we reserve the right to pursue recovery of the goods or their value.
Delivery terms, carriers, timeframes, costs, and the free shipping threshold are set out in our Delivery Terms, which form part of these Terms and are available at klarq.ee/shipping.
Risk of accidental damage or loss passes to you (the consumer) upon physical delivery of the goods to you or a person designated by you. For Business Customers, risk passes upon handover to the carrier.
Ownership (title) of the goods transfers to you upon our receipt of full payment.
If you are a consumer, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason. Full details (including the model withdrawal form, exemptions, and refund procedure) are set out in our 14-Day Right of Withdrawal document, which forms part of these Terms and is available at klarq.ee/returns.
The right of withdrawal does not apply to Business Customers.
All products sold by Klarq come with a statutory 2-year legal guarantee under Estonian and EU law. This means that if a product is not in conformity with the contract at the time of delivery, you are entitled to a remedy (repair, replacement, or refund) depending on the circumstances.

We are responsible for losses you suffer that are a direct and foreseeable result of our breach of these Terms or our negligence. We are not responsible for: • Indirect or consequential losses that are not foreseeable; • Loss of profit or business opportunity (for Business Customers); • Losses caused by events outside our reasonable control (see §11); • Losses arising from your own misuse of the product or failure to follow instructions.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited by law.
Consumer rights are not affected. If you are a consumer, none of the above limitations affect your statutory rights under Estonian or EU law.
We will not be in breach of these Terms if we are unable to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government restrictions, or carrier disruptions. If such an event occurs, we will notify you as soon as reasonably possible. If the situation persists for more than 30 days, you may cancel your order and receive a full refund.
All content on the Shop, including text, images, logos, and software, is the property of Brandweb OÜ or its licensors. You may not copy, reproduce, or redistribute any content without our prior written consent.
We process your personal data in order to manage your orders, deliver products, handle returns, and comply with legal obligations. Your data is handled in accordance with our Privacy Policy, available at klarq.ee/privacy. Our processing is based on the performance of a contract (your order), compliance with legal obligations, and where applicable your consent.
The personal data necessary for the execution of payments is transferred to authorised processor Maksekeskus AS. Please refer to Maksekeskus's data protection terms at makecommerce.net/terms-and-conditions-of-data-protection for details.
These Terms are governed by and interpreted in accordance with the laws of the Republic of Estonia. EU consumer law also applies where mandatory. If you are a consumer resident in another EU member state, you retain the protection of mandatory provisions of the law of your country of residence.

We are not obliged to participate in alternative dispute resolution proceedings beyond the Consumer Disputes Committee listed above, unless required by law.
We may update these Terms from time to time to reflect changes in law, our business practices, or for other legitimate reasons. The version in force at the time you place your order applies to that order. We will notify registered customers of material changes by email where possible.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
